DO I NEED A MENTAL EXAM

The defendant argued that the plaintiffs had criminal backgrounds and one faced domestic abuse charges and two had undergone court-ordered anger management. The defendant asserted that other mental, physical or social factors might have contributed to the alleged distress claimed by plaintiffs.

YOU BE THE JUDGE: Does an LAD plaintiff claiming emotional distress subject himself to the risk that a court may order psychological evaluations? The motion judge denied defendant’s request. The judge noted that the LAD was intended to provide an expansive remedy to plaintiffs and that the Legislature recognized emotional distress is sometimes a factor in assessing damages.

The judge found the plaintiffs’ criminal histories did not give rise to an alternate explanation for the pain and suffering claimed by plaintiffs and evidence of alternative possibilities would likely confuse the jury. The judge also noted there was no New Jersey decision which supported defendant’s request for an examination.

How To Appeal Against Detention Under The Mental Health Act

If you are detained in hospital under the mental health act, there are two different types of appeal available and you can use either or both. You can appeal to the Hospital Managers and/or the First Tier Tribunal (Mental Health), both are described below. Before making an appeal, it is advisable that you source either a Legal Advocate or a Solicitor to help you make an appeal, to advise you and represent your interest at your hearing.

Appeal to the Tribunal

The Tribunal is a statutory body that has responsibility for hearing appeals of patients under detention of the Mental Health Act. They are independent of the hospital you are detained at and the panel will visit the hospital to hear the appeal. The panel will be a legal person who is a Lawyer A doctor, usually a psychiatrist and a Lay Member who has experience of mental health matters.

Your Responsible Clinician, Named Nurse and Social Worker will usually attend the Tribunal. You may attend with your nearest relative and your Advocate or Solicitor will attend to represent your interests.

All patients who appeal to tribunals are entitled to legal representation through Legal Aid Funding. A solicitor or advocate will be able to arrange this for you.

You have the right of appeal once during detention under S2 which must be submitted within the first 14 days of your detention. You have the right of appeal once in the first 6 months of detention under S3 which can be submitted at any time. For longer periods of detention the rules change and your Advocate/Solicitor can advise you of how the rules apply in your case.

The Mental Health Act states that you have the right to an independent review of your case so if you have been in hospital for more than six months , and have not made an appeal to the Tribunal, the Hospital Managers will refer your case and a Tribunal will consider your detention whether you want them to or not. For longer periods of detention the rules change however you always retain the right of appeal or referral to the Tribunal. Some of the rules are be different if youve been sent to hospital by a court, or transferred from prison, but your Advocate/Solicitor can advise you of how the rules apply to your case.

Appeal to the Hospital Managers

Hospital managers are people appointed by the hospital because they have knowledge of Mental Health matters they are independent of the hospital and will sit on a panel to consider appeals and referrals against detention under the Act.

They are bound by the guidance in the mental health act Code of Practice and decisions they make can be challenged in the courts. The Hospital Managers must therefore adopt and apply a procedure which is fair and reasonable, not make irrational decisions that is, decisions which no managers panel, properly directing itself as to the law and on the available information, could have made, and not act unlawfully, that is, contrary to the provisions of the Act and any other legislation (including the Human Rights Act 1998 and relevant equality and anti-discrimination legislation). It is always advisable to have an Advocate or Solicitor with you at a Managers appeal.

Save Mental Energy!

When I was busy, I would never think of anything negative. But when I was not busy, I would start to think of all kinds of things especially those things that caused worry and anxiety. Then I would become worried and depressed.

Does this sound familiar to you?

As usual, I am curious to know why. After some research and meditation, this is what I have found out based on my interpretation.

Like it or not, it is the nature of the mind to be always busy with thoughts. The mind is always thinking of a lot of things every second. The mind never stops to rest. The mind is always running around very fast thinking of this and that.

When I was busy with reading a book, what actually happened is that I kept my mind busy with the thought of reading the book. Thus, my mind is not free to wander around. That is why I did not think of any other things except the task on hand.

When I was free, I did not kept my mind busy with any particular thought. As a result, my mind became free to choose what I like to think about. If my mind thought of something worrying, then I would become worried. If my mind thought of something depressing, then I would become depressed. Because my mind is very fast in nature and free to roam around, I will end up thinking of a lot of things.

This is a waste of mental energy because I have allowed my mind to dwell in negative thoughts. To avoid this trap of wasting mental energy, I should always keep my mind busy with something that is not negative in nature.

For examples, if I am traveling in a bus, I can simply count 1 after each breath. I can count from 1 to 10 and keep on repeating. In this way, I will be too busy counting that I do not think of negative things. If I am waiting for someone, I can simply occupy myself by counting my fingers.

It does not matter that my focus is on something trivial. As long as I can prevent myself from thinking of negative thoughts, it is worth doing it. In this way, I save myself the trouble of becoming mentally disturbed due to negative thoughts.

How’s Your Mental Conditioning

Until the negative conditioning is reversed, the ability to persist until a goal is achieved can become problematic. When we are about to pursue a goal or objective, negative conditioning generally manifests as self- doubt or self-limiting beliefs. The belief that we are incapable or that we will fail. The belief that others will laugh at us or even consider our idea ludicrous.

The fact is that despite their conditioning, even successful people experience some degree of these emotions before they undertake an enormous goal. The advantage they have however is that their confident conditioning allows them to push past the anxiety and worry and focus only on the favourable outcome that they expect.

Negative conditioning has a less apparent but lethal side effect. Despite having achieved success, people who have not fundamentally addressed their negative conditioning and their feelings of inadequacy or low self-worth can sabotage their success; often times without even being aware of their damaging actions.

A deep rooted belief that they are undeserving of success will often demonstrate itself in the fear of losing it all and as this becomes a strongly held fear in their subconscious, they begin to display actions that is in line with their expectations.

They begin to undermine themselves though destructive behaviour such as extravagant lifestyles, alcohol and drug abuse, neglecting their businesses, until their fear eventually becomes a reality and they lose everything. Their fear now a reality now further reinforces what they always subconsciously fear and believed, even though such fear was unfounded and such belief untrue.

The good news is that reverse negative beliefs and conditioning is not as difficult or impossible as we may think. Due to the neuroplasticity of the brain, such beliefs can be unlearned in the same way that they were learned. It was previously thought that thinking and physical habits were permanently hardwired and once formed where virtually impossible to break.

However, neuroplasticity of the brain proposes that the human brain can be rewired to adopt a new belief or habit to replace the old thinking pattern and bad habits. By consistently holding a new belief or performing a new action, new neural pathways are physically created in the brain and the more such thought is held, or action performed, the more hardwired the pathway becomes until it eventually becomes a new habit. Therefore the mechanism of neuroplasticity can be directly applied to our beliefs and we can use it to replace old, limiting beliefs about ourselves and our abilities with more positive and empowering beliefs.

Focus on your accomplishments: Whenever feelings of self doubt arise, think of past circumstances when you were successful and how you exceeded your own expectations. Remember the emotions you felt as a result of your achievements. Focus on those emotions and let them be your anchor. If you had been successful in the past, you can replicate it in the future. Past successes or failures will only repeat themselves in our future endeavours if we believe they will and if we allow them to.

Learn from your failures: successfully unlearning negative conditioning requires changing how we think of failures. Thinking of past failures as barometers of our future potential will keep us stuck in a vicious cycle of inaction and fear. However, by repositioning our views of failures as learning experiences, not only do we build strength of character but we become better prepared us for our next attempt. Instead of self doubt, we begin to develop self respect and a healthier self image. Learn from the experience and determine what needs to be done differently next time. Then apply what you have learnt the next time around.
Before changing your negative conditioning about a situation in your life, ask yourself the following and answer honestly
-What excuses are you using currently to justify the current state of your life, the frustrating situation at work, not following through your goals, your financial situation?
-Is your goal to change your situation really a strong desire or just a wish?
-Have you taken responsibility for your situation?
-Will keeping on making excuses reverse or change the situation?
-It possible that others have had a similar experience and thrived despite the challenges?
-Have you really, really thought of every feasible solution? What can you do differently?
-What will your life be like in 5 years if you dont follow through on your goals?
-Can you afford to pay the price of your laxity in 5 years?
Ask yourself the hard questions and as the true nature of your underlying beliefs begins to emerge, you will begin to appreciate the amazing potential you have been supressing for so long.
